Kenya’s Court of Appeal Reverses High Court Decision on Abortion Rights

Landmark Kenyan Court Ruling Reshapes Abortion Jurisprudence, Declares Abortion Not a Fundamental Right

Kisumu, Kenya – In a significant development for Kenyan law, the Court of Appeal in Malindi delivered a landmark judgment on April 24, 2026, clarifying the nation’s abortion jurisprudence. The court firmly held that abortion is not a fundamental right under the Kenyan Constitution, overturning a previous High Court ruling and sparking widespread debate across the country.

The case stems from a 2022 High Court decision in PAK & another v Attorney General & 3 others, which controversially found that access to abortion fell within constitutional protections related to health, dignity, and freedom from cruel treatment. This ruling arose from a sensitive case involving a teenager facing pregnancy complications and subsequent arrest following post-abortion care. The High Court’s decision had effectively broadened reproductive rights, prompting the state to develop a more comprehensive legal and policy framework.

However, the ruling was challenged by various parties, including the Kenya Christian Professionals Forum and the State Law Office, who argued that the High Court had misinterpreted Article 26 of the Constitution. These appellants contended that life begins at conception and that abortion should only be permissible under narrowly defined circumstances.

The Court of Appeal, comprised of Justices Gatembu Kairu, Grace Ngenye Macharia, and Kibaya Laibuta, sided with the appellants in their April 24, 2026, decision. The judges emphasized that Articles 26(1) and (2) of the Constitution explicitly protect the right to life from conception, asserting that terminating a pregnancy generally violates this right.

The court clarified that abortion is permissible only in limited situations: when a trained health professional deems emergency treatment necessary, when the mother’s life or health is in danger, or when another written law specifically permits it. This decision effectively reinstated a stricter constitutional and statutory framework, reinforcing the relevance of Penal Code provisions criminalizing unlawful abortion.

Immediate Reactions and Future Implications

The ruling has elicited strong and immediate reactions throughout Kenya. Religious and conservative groups have lauded the decision as a victory for the sanctity of life, while human rights organizations and medical professionals have expressed concern, viewing it as a setback for reproductive health rights. Advocacy groups, such as the Center for Reproductive Rights, have already indicated plans to appeal the decision to the Supreme Court, citing concerns about potential dangers to access to emergency care and increased stigma surrounding reproductive health services.

Public opinion is sharply divided, as reflected in the polarized national debate on social media. While some Kenyans view the judgment as upholding the Constitution, others consider it regressive, particularly given the documented link between unsafe abortions and maternal mortality.

The implications of this ruling are far-reaching. Legally, it restricts the scope of reproductive rights and reinforces judicial adherence to the Constitution’s text. Practically, it places healthcare providers under increased scrutiny and may discourage women from seeking essential medical care. Politically and socially, the decision sets the stage for a likely Supreme Court challenge, ensuring that the contentious issue of abortion rights in Kenya remains a subject of intense debate and legal scrutiny.
