The New Jersey Legislative District 13, comprised of Senator Declan O’Scanlon, Assemblywoman Victoria Flynn, and Assemblyman Gerry Scharfenberger, has released a statement regarding the Supreme Court’s recent ruling in Mirabelli v. Bonta. The delegation believes the decision warrants a review of New Jersey’s legal actions against school districts.
Senator O’Scanlon stated the Supreme Court’s opinion underscores constitutional limitations on government actions, particularly those impacting parental rights and mandated conduct. He indicated that states have a responsibility to ensure their actions align with these constitutional boundaries when the Court expresses concerns about government overreach.
Assemblyman Scharfenberger emphasized that school districts already facing reductions in state aid should not encounter further pressure from the state. He suggested that the state should collaborate with local districts rather than pursuing legal disputes, particularly as local school boards grapple with decreased state funding. He also stated parental rights should not be jeopardized by state actions.
Assemblywoman Flynn suggested the Supreme Court’s decision presents an opportunity for the new state Attorney General to adopt a different strategy. She criticized the previous Attorney General’s reliance on litigation over communication and expressed hope that the new Attorney General will prioritize dialogue with local communities and redirect state resources away from what she described as politically motivated legal actions.
