Sports Tribunal Freezes Promotion and Relegation Across Kenyan Football Leagues

The Sports Disputes Tribunal (SDT) has issued temporary orders suspending all promotion and relegation processes across the Kenyan Premier League, National Super League and FKF Division One pending determination of a legal challenge over the application of the 2025 competition regulations. The decision immediately pauses movement of clubs between divisions and leaves uncertainty over the composition of next season’s leagues.

The dispute centres on whether Football Kenya Federation lawfully applied the 2025 regulations during the concluded season. Petitioners argue that the season began under the 2019 rules and that changes introduced later could not be enforced retrospectively without following constitutional procedures within the federation.

According to the legal challenge, the difference between the two regulatory frameworks carries major sporting consequences. Under the 2019 regulations, two clubs move automatically while an additional playoff determines the final promotion or relegation place. Under the contested 2025 regulations, three teams move automatically without a playoff structure.

The tribunal had previously indicated concerns that the 2025 regulations may not have been formally approved through the federation’s required governance mechanisms. Earlier findings linked to football governance disputes questioned whether key decisions affecting league administration were properly adopted under FKF structures.

In the latest orders, SDT moved to preserve the status quo until the case is fully heard. The tribunal restrained FKF from implementing decisions that assume confirmed promotion or relegation and also stopped publication of league structures that rely on the disputed framework.

One of the clubs directly affected is Kariobangi Sharks, whose league status became part of the wider legal battle after FKF announced changes touching promotion and relegation arrangements. The tribunal held that immediate implementation could create irreversible consequences before legal questions are settled.

The ruling has now created uncertainty for clubs across all affected divisions. Teams that believed they had secured promotion must wait for legal clarity, while clubs facing relegation have received temporary relief. Season planning, player recruitment, sponsorship discussions and fixture preparation could all face delays as the process unfolds.

Attention now shifts to the next tribunal hearings and any possible court proceedings involving FKF. The final judgment is expected to determine not only which clubs move between divisions but also establish which regulatory framework will govern Kenyan football competitions going forward. Until then, promotion and relegation remain officially on hold.
