Senate Majority Leader John Thune (R-SD) stated that Republicans are “prepared” to confirm a replacement for Justice Alito if he retires at the end of the current Supreme Court term, which concludes in June or early July. Thune clarified that the confirmation process would occur before the November midterm elections.
Republicans currently hold a three-seat majority in the Senate. Democrats could potentially regain control of the chamber if a significant number of voters support Democratic candidates in the midterm elections. The midterm election map is generally considered favorable for Republicans.
Justice Alito, 76, has not publicly indicated plans to retire. Speculation regarding his potential retirement is partly driven by a desire to avoid a situation similar to that faced by Democrats when Justice Ruth Bader Ginsburg passed away during President Donald Trump’s first term. At that time, Trump appointed Justice Amy Coney Barrett to fill the vacancy. The current Supreme Court has a 6-3 conservative majority, with Justices Neil Gorsuch and Brett Kavanaugh also appointed by Trump.
While retirement rumors have primarily focused on Justice Alito, Justice Clarence Thomas, 77, is also among the older members of the Supreme Court.
Former President Donald Trump expressed his hope that Justices Alito and Thomas would remain on the court, describing them as “fantastic” in a December 2025 interview with Politico.
