The U.S. Court of Appeals for the Sixth Circuit has reversed a decision granting qualified immunity to a Canton, Ohio police officer involved in the fatal shooting of James Williams. The ruling allows the Williams family’s civil rights claims to proceed to a jury trial.
The incident occurred on January 1, 2022, during a New Year’s Eve celebration at the Williams family home in Canton.
The Shooting Incident
James Williams was fatally shot on January 1, 2022, while celebrating New Year’s Eve with his wife and three children at their Canton home. After hearing celebratory gunfire, a Canton police officer positioned outside the property fired multiple shots through a wooden privacy fence without warning, striking Williams six times. He succumbed to his injuries.
Sixth Circuit Ruling
The Sixth Circuit affirmed a federal court’s denial of summary judgment in the case of Marquetta Williams, et al. v. City of Canton, Ohio, et al. The court determined that disputed factual issues, specifically whether Williams aimed his firearm at the officer, require resolution by a jury. The appellate court stated that, considering the evidence in a light most favorable to the Williams family, a jury could reasonably conclude that Williams was firing into the air—an alleged misdemeanor in Canton—and did not pose an immediate threat. The court noted the absence of 911 calls, reports of violence, or signs of danger. The court rejected the argument that qualified immunity should apply solely due to the lack of a prior case with identical facts.
Pending Claims
The ruling permits the family’s excessive-force claims against the officer to proceed to trial. Claims against the City of Canton and police supervisors remain intact. These claims allege failures in officer training and the existence of a potentially problematic “shoot first” culture within the Canton Police Department.
