US Loses Attempt to Halt Alabama Trans Care Ban Litigation

A federal court in Alabama denied on Tuesday an attempt by the Biden administration to halt litigation against the state’s gender-affirming care ban while appeals courts sort out the proper standard of review to use in the case and related ones.
Pausing the case “may indeed be the most efficient way to proceed in this case, but not unless a higher court signals that it will decide the governing standard of review,” according to the order from Judge Liles C. Burke for the US District Court . . .
