Black Postal Employee’s Promotion Bias Claim Revived for Trial

A Black woman passed over for a supervisory position in her Michigan post office is entitled to a race bias trial, because a jury could find she was “significantly more qualified” than the White woman who got the job.

The ruling Monday by a divided US Court of Appeals for the Sixth Circuit addresses when Title VII of the 1964 Civil Rights Act requires courts to depart from the general rule that employers have the right to choose their own workforce.

A departure is required when there’s evidence of race or other prohibited discrimination . . .
